Mandate

As the competent authority in constitutional matters, the Council specifically rules on:

  • The constitutionality of laws, treaties, and international agreements;

  • The internal rules (standing orders) of the National Assembly and the Senate, as to their conformity with the Constitution, prior to their implementation;

  • Conflicts of jurisdiction (conflicts of attribution): between State institutions; between the State and the regions; between regions;

  • The regularity of the presidential election, parliamentary elections, and referendum consultations. It proclaims the results thereof.

It issues decisions and opinions (advisory opinions) in matters within its competence. These take effect upon being rendered and are not subject to any appeal.

These powers are enshrined in Articles 47 and 48 of the Constitutional Law of January 18, 1996.
