How to Refer a Matter to the Constitutional Council

The Constitutional Council cannot initiate proceedings on its own initiative.

In the context of reviewing the constitutionality of laws pending promulgation, international treaties and agreements prior to their ratification, the Internal Regulations of the two Houses of Parliament, the settlement of  jurisdictional conflicts between institutions, disputes regarding the admissibility of bills, and within its advisory capacity, the Constitutional Council may be referred to by a simple petition, dated and signed by the petitioner (President of the Republic, President of the Senate, President of the National Assembly, 1/3 of Senators, or 1/3 of Deputies).

For challenges and claims relating to electoral operations, the Constitutional Council is referred to by a simple petition, dated and signed by the petitioner.
